Article 1 - Purpose

These Terms and Conditions govern the contractual relationship between Linkup Coaching SAS (RCS 493 862 007 Nanterre), publisher of the platform "The Coach Pilot" accessible at thecoachpilot.com, and any individual or legal entity wishing to use the services offered.

Article 2 - Access to Services

Access to The Coach Pilot services requires creating a user account. The user agrees to provide accurate and up-to-date information during registration.

A 14-day free trial is offered to new registrations, providing access to all premium features. At the end of this period, the user can choose to subscribe to one of the paid plans or continue with the free plan with limited features.

Article 3 - Description of Services

The Coach Pilot is a SaaS (Software as a Service) platform for professional coaches.

Available plans are: Free, Monthly User (monthly subscription), and Annual User (annual subscription).

Article 4 - Pricing

Prices are displayed in euros (EUR) for European users and in US dollars (USD) for other regions, based on user geolocation.

Current rates are available on the website's pricing page. Linkup Coaching SAS reserves the right to modify its prices at any time, with new prices applying only to new subscriptions.

Article 5 - Access Terms

Access to services is available 24/7, subject to interruptions for maintenance or updates. Linkup Coaching SAS commits to informing users of any extended scheduled maintenance.

Article 6 - Financial Terms

Payment is made exclusively by credit card via the secure Stripe platform. Subscriptions are automatically renewed monthly or annually depending on the chosen plan.

Invoices are automatically generated and available in the user area. Payment data is processed exclusively by Stripe and is never stored on The Coach Pilot servers.

Article 7 - Privacy and GDPR

Linkup Coaching SAS commits to complying with European data protection regulations (GDPR). Data collected is used solely for service provision and is never sold to third parties.

Article 8 - Liability

Linkup Coaching SAS implements all reasonable means to ensure continuous and quality access to its services. However, it cannot be held liable in case of:

• Internet network malfunction
• Non-compliant use of services by the user
• Malicious intrusion by third parties despite security measures in place
• Force majeure as defined by Article 1218 of the French Civil Code

Article 9 - Intellectual Property

All elements constituting The Coach Pilot platform (design, code, content, algorithms, methodologies) are the exclusive property of Linkup Coaching SAS.

Test results and analyses generated by the platform remain the property of the user who may use them freely in their professional activity.

Article 10 - Termination

The user may cancel their subscription at any time from their personal area. Cancellation takes effect at the end of the current subscription period, without pro-rata refund.

Linkup Coaching SAS reserves the right to suspend or terminate a user's access in case of non-compliance with these Terms, particularly in case of abusive or fraudulent use of services.

Article 11 - Force Majeure

Linkup Coaching SAS cannot be held responsible for failure to perform its obligations in case of force majeure as defined by Article 1218 of the French Civil Code, including natural disasters, wars, strikes, general telecommunications network failures.

Article 12 - Terms Modifications

Linkup Coaching SAS reserves the right to modify these Terms at any time. Users will be informed by email of any substantial modification. Continued use of services after modification constitutes acceptance of the new conditions.

Article 13 - Applicable Law

These Terms are subject to French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of French courts.

Article 14 - Disputes

Use of The Coach Pilot services implies full and complete acceptance of these Terms and Conditions.
